As you are aware, the law implementing Regulation (EU) 2016/679 of the Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and the free circulation of such data, also known as the General Data Protection Regulation (hereinafter referred to as GDPR).
For the purposes of complying with the provisions of the RGPD, the entity Texteis Texdia, SA, hereinafter referred to as Texdia, which has the present website texdia.pt, hereby informs that:

1. Responsible for data processing

The main person responsible for processing your data for the purposes of our services will be Texteis Texdia, SA, with corporate identification number 501565140 and headquarters at Rua das Vinhas no 232, 4765-764 Oliveira de São Mateus. 2. Collection and use of personal data

2.1. In accordance with Texdia’s commercial activity, we inform you that we will not enter into any contracts with final consumers, but only and only with collective and/or professional entities, therefore, in purchase and sale relationships, we will avoid the collection and processing of personal data of persons singular. However, from a preventive perspective and in case the collection and processing of personal data of natural persons succeeds, we have prepared this privacy policy.

2.2. With a view to exercising its activity and for the purposes of contact with its customers, Texdia may collect, with the authorization of the respective holders, data of a personal nature, provided voluntarily, in any form, namely: names of natural or legal persons, tax identification number, address/headquarters, email address and telephone contact.

2.3. The data identified above are collected and processed for the purpose of their proper use and compatible with the correct and necessary development of Texdia’s commercial activity and for legal and functional issues inherent to the operation of its goods and/or services.

2.4. The personal data collected may be used, when permitted by law, for the following purposes: communications with a view to providing information regarding Texdia’s activity and respective goods and services, any type of communications/questions regarding contracts about to be entered into or concluded or in progress, invoicing, deliveries and other actions that appear necessary within the scope of the relationship established between Texdia and the data subject. 2.5. The data subject authorizes Texdia to collect, process and use their personal data under the terms and for all purposes described in this document. Authorization can be withdrawn at any time.


3. Legal basis

3.1. The processing of personal data carried out by Texdia is based on several legal bases, depending on the respective purposes:

a) Execution of a contract or pre-contractual steps at the request of the data subject (any types of communications/questions regarding contracts about to be entered into or concluded or in progress, invoicing and deliveries);

b) Consent of the data subject (use of performance cookies for statistical analysis and any types of communications/questions regarding contracts about to be signed or signed or in progress, billing and deliveries);

c) Texdia’s legitimate interest in managing and improving its website, as well as ensuring that it is used in accordance with the respective terms and conditions, control and fraud prevention;

d) Compliance with legal obligations to which Texdia is subject.

3.2. When data processing is based on Texdia’s legitimate interest, we adopt the necessary measures to analyze the effects that the processing has on your interests. Texdia will not process your personal data if from that analysis it concludes that our interests are superseded by your rights and freedoms.

4. Confidentiality, security and data conservation

4.1. The data collected by Texdia is stored on its system and is treated by it in a secure and confidential manner.

4.2. The processing and access to data is restricted to Texdia employees/collaborators who carry out professional tasks that, by their nature, imply intervention and/or management of the relationship between Texdia and the data subject.

4.3. Personal data will be kept by Texdia for the necessary period of use, namely, during all the time in which the relationship is maintained between itself and the respective data holders or the subsistence of the purpose for which the data were collected. Once the period that justifies their conservation has ended, the data will be destroyed within a suitable period for this purpose.


5. Transfer of data

5.1. Without prejudice to their confidentiality and proper treatment, the holder authorizes Texdia to transfer their data (only those strictly necessary) to third parties, such as accounting firms contracted by us externally, where accounting services are provided to us.

5.2. Your data may also be transmitted to third parties, whenever there is a legal obligation that justifies the communication of data.

5.3. Texdia will not sell any data collected to third parties.


6. Amendment to the privacy statement

6.1. Texdia reserves the right at any time and without prior notice and with immediate effect, but without prejudice to the legal rights granted to data subjects, to change, add or revoke, partially or totally, this privacy policy.

7. Rights of the data subject

7.1. The data subject provided to Texdia has the right to request access to their personal data (known as “data subject access request”). This allows you to receive a copy of the personal data we hold about you and to check that we are processing it legally.

7.2. The holder of data provided to Texdia has the right to request corrections to any data we hold about him. This allows you to correct any incomplete or incorrect data we hold about you, although we are obliged to verify the accuracy of the new data you provide to us.

7.3. The holder of data provided to Texdia has the right to request the limitation of processing of their personal data. This allows you to request the suspension of the processing of your personal data in the following circumstances:
(a) if you want us to determine the accuracy of the data;
(b) whenever our use of the data does not comply with the law;
(c) whenever you need us to store your data, even if you do not need them, in case you need to establish, exercise or defend against legal claims; or
(d) if you disagreed with our use of your personal data, although we are obliged to check that there are overriding legitimate interests for us to continue using it.

7.4. The holder of data provided to Texdia has the right to request the deletion of their personal data. This allows you to request that we erase or remove your personal data whenever there is no good reason for us to continue processing it. You also have the right to ask us to erase or remove your personal data where you have successfully exercised your right to refuse processing (see below), where we have processed your information unlawfully or where we are required to delete your personal data for the purposes of compliance with local law. Please note that, for certain purposes, we may be legally obliged to retain your data.

7.5. The holder of data provided to Texdia has the right to object to the processing of his personal data whenever we use a legitimate interest (or the legitimate interest of a third party) and whenever there is something related to his personal situation that leads him to contest your processing in these terms, considering that this could have a fundamental impact on your fundamental rights and guarantees. He also has the right to object whenever we process his personal data for direct marketing purposes. In some cases, we may demonstrate that we have legitimate and compelling reasons that override your rights and guarantees to process your information.

7.6. The holder of data provided to Texdia has the right to request the portability of his personal data for himself or for a third party. We will provide you, or provide a third party of your choice, with your personal data in a structured, commonly used, electronically readable format. Please note that this right only applies to automated information for which you initially gave us your consent to use it or in situations where we have used the information for the purposes of fulfilling the contract we have entered into with you.

7.7. The holder of data provided to Texdia has the right to withdraw consent, at any time, for the processing of their personal data. This does not affect the legality of any processing that we have already carried out based on the previously given consent.

7.8. The data subject will not have to pay any fee to access their personal data (or exercise any of the other rights). However, we may charge you a reasonable fee if your request is manifestly unfounded, repetitive or excessive. On the other hand, we may refuse to comply with your request under these circumstances.

7.9. We try to respond to all legitimate requests within one month. Occasionally, it may take longer than a month if your order is particularly complex or if you have placed multiple orders. In that case, we will notify you and keep you informed. 7.10. Furthermore, you have the right to make a complaint at any time to the responsible data protection authority identified in point 14.


8. Security

8.1. Texdia prevents unauthorized access or disclosure, using, for this purpose, various security measures, including strengthening passwords, in order to help protect and maintain the security, integrity and availability of your personal data.

8.2. We have implemented measures to help protect the personal data in our custody and control. We maintain reasonable administrative, technical and physical safeguards in an effort to ensure protection against unauthorized access, use, alteration and disclosure of personal data in our custody and control. Unfortunately, it is not possible to guarantee with 100% certainty that information will not be collected or transmitted over the Internet or other communication networks accessible to the public, so it is not possible for us to guarantee the security of said information.

8.3. We have personal data retention processes in place to retain our customers’ personal data for the period necessary for the above purposes or to otherwise comply with legal requirements.


9. Communication

We will communicate with you by email, SMS or call to confirm an order, for information requests, for complaints, suggestions or compliments, or for other transactional messages related to our services. As such transactional messages are binding on us, you cannot refuse them.


10. Data storage

10.1. The data we collect about you will be stored and processed within the EEA on secure servers in order to provide the best possible user experience. For example: for quick links to the website or mobile application if applicable.

12. Data protection on social networks

12.1. On our website you can find links to our social networks.

12.2. Texdia is responsible for processing data on social networks belonging to Texdia.

12.4. We have only limited influence on the data processing carried out by operators of social media platforms (eg member management and shared information). In situations where we have the ability to influence, we ensure that the operator of the social media platform acts in accordance with data protection requirements, within the possibilities available to us. However, in many situations, we cannot influence the data processing carried out by the operator of the social media platform and, also, we do not have precise knowledge of which data is processed in this context.

12.5. The operator of the social networking platform operates the entire IT infrastructure of the service, defines its own data protection rules and maintains its own relationship with users (insofar as they are registered users of the social network).

Additionally, the operator is solely responsible for all matters relating to his user profile data, to which Texdia does not have access.

12.7. The purpose of the data processing carried out on our pages is to inform customers about Texdia’s commercial activity and to interact with page visitors on these matters, as well as to respond to any questions, praise or criticism.

12.8. We reserve the right to delete content as necessary. This is the case, for example, of publications that violate rights or are illegal, hateful comments, offensive comments (such as explicit sexual content) or attachments (for example, images or videos) that may violate copyright, rights of personality, penal laws or ethical principles.

12.9. The operator has no influence on the processing of data carried out by Texdia within the scope of communication with customers.

12.10. In cases where the platform operator grants us this possibility, we ensure that our pages comply, as much as possible, with the data protection regulations in force.

12.11. The data you enter on our pages, such as comments, videos, photos, likes, public messages, etc., will be published by the platform and will never be used or processed by us for other purposes.

12.12. All personal data that you make available to us (suggestions, compliments or criticisms) by private message will be securely deleted or anonymized by us, within a maximum period of 90 days after sending our final response. The retention of data for 90 days is justified by the fact that, after sending a response, the customer may contact us again on the same subject, and it may then be necessary for us to consult previous correspondence. In our experience, we generally do not receive requests for further clarification on our responses after 90 days.

12.13. All publications of a public nature made by you on our pages remain there indefinitely, unless we delete them as part of an update of the matter in question.

12.14. We have no influence on the deletion of your data by the operator itself. Consequently, the privacy policy of the operator in question also applies.
